As a reminder, your use of Sprint Touch is governed by Sprint's General Terms and Conditions of Service, which are available at sprint.com/termsandconditions, which contain a mandatory arbitration provision that provides that (except for matters properly brought to small claims court) any claim, controversy, or dispute of any kind between you and Sprint must be resolved by final and binding arbitration on an individual and not a class-wide or consolidated basis.
Security. You agree to use and safeguard the PINs and other security features of all of the applications that use Sprint Touch. You are responsible for all uses of your Device (whether by you or someone else, either with or without your knowledge). If you are recycling or reusing your phone or giving your phone to a third party (for example, your phone is being repaired), Sprint recommends that you remove all cards from Sprint Touch. If your phone is lost or stolen, Sprint recommends that you contact the issuers of all cards stored in Sprint Touch.
Sprint Is Not a Merchant or Credit Card Provider. Sprint's services are limited to storing and providing to merchants your payment account information and certain personal information necessary to carry out the services. Sprint does not: (i) process payment transactions between you and merchants; (ii) set the terms of any purchase transaction between you and merchants; (iii) endorse or have any liability for products or services purchased; or (iv) control or have any liability for returns, refunds, changebacks, or other questions or disputes you may have with any merchant related to any purchase transaction. You agree to look solely to the applicable merchant or the provider of your payment account to resolve all questions and disputes regarding purchase transactions. Nothing in your agreement with Sprint modifies any agreement between you and the issuer of your payment account.
